The Bankruptcy Practice Group at Hamilton Moon Stephens Steele & Martin, PLLC is led by Tom Moon, who has been practicing debtor-creditor law in Charlotte for 35 years.  Under his guidance, this section is one of the most experienced and skilled bankruptcy practice groups in the city of Charlotte, and one of the few which focuses primarily on the representation of corporate and individual debtors in chapter 11 bankruptcy cases.  Clients whom the Firm and members of the Bankruptcy Practice Group have represented, range from publicly-traded companies to sole proprietorships, to non-profit corporations, to individuals.  In representing debtors, the Bankruptcy Practice Group draws upon not only its own expertise, but is able to utilize the vast experience in the Firm's other practice groups to provide advice and counsel on all matters arising in chapter 11 proceedings including, public and private sales of assets, financing, restructuring of debt, determination of the validity and extent of secured liens of creditors, valuation of assets, analysis and prosecution of bankruptcy causes of action, and formulation and presentment of chapter 11 plans.


Members of the Bankruptcy Practice Group are admitted to practice in North Carolina and California and have practiced before all federal bankruptcy districts in North and South Carolina, the Southern District of New York, the Southern District of California and the District of Delaware.


Notable cases in which the members of the Bankruptcy Practice Group have participated in lead counsel roles, include Acme Petroleum & Fuel Company (W.D.N.C.), Sharon Luggage, Inc. (W.D.N.C.), Southeastern Transport, Inc. (W.D.N.C.), F.T. Williams, Inc. (W.D.N.C.), and HLM Design, Inc. (W.D.N.C.).


Because of the Bankruptcy Group's considerable experience in representing chapter 7 and 11 debtors, it is also able to provide extremely effective assistance to all types of creditors and parties in interest seeking to protect their interests in bankruptcy proceedings.  The Firm and Bankruptcy Practice Group members have represented official committees of unsecured creditors, individual secured and unsecured creditors, lenders, shareholders, insurers, and potential purchasers, in bankruptcy and workouts.  The Firm has experience filing claims, defending preference or other avoidance actions, and handling other creditor-oriented issues such as reclamation, consignment, UCC issues and receiverships.
