Rebecca K. Cheney

Biography

Becky Cheney’s practice is primarily litigation, with an emphasis on construction and local government matters. In the construction litigation context, she represents local governments and other owners, design professionals, and contractors in disputes related to public and private projects. She also represents local governments in litigation of zoning matters, public bidding and contract disputes. She represents both property owners and governments in condemnation matters.


With regard to more general litigation matters, Becky has handled various types of business and property disputes including breach of contract, private nuisance, trespass, enforcement of guarantees, misappropriation of trade secrets, intellectual property infringement, and breach of fiduciary duties among members/managers of LLCs.


Outside of litigation, she counsels local governments and contractors, owners and design professionals on pre-contract procedures and compliance with the foregoing areas of substantive law, with an eye toward avoiding litigation. She negotiates and drafts bid documents, contracts for construction, design services and procurement, leases and concession agreements. She advises local governments on regulatory compliance, governance, zoning, public bidding, contract award, public records, open meetings, sovereign immunity and liability.


Becky has experience in all aspects of representing a large hub commercial airport, including federal regulatory compliance (grant assurances, revenue diversion, procurement, Disadvantaged Business Enterprises), property acquisition and condemnation, contracting and bidding for construction, goods and services, bankruptcy, premises liability, governance and First Amendment.
